In order for San Diego Gas & Electric to market or lobby against the alternative energy program - "community choice aggregation", it has taken the unusual step of sending a notice to the California Public Utilities Commission outlining plans to form an independent marketing district. This would be "functionally and physically separate from the utility’s ratepayer-funded divisions".

According to state law, Friday Nov. 20 actions, were the only legal option available and is the first utility in the state, to take this step.

San Diego Gas & Electric currently purchases energy for all residents and businesses in San Diego. Under community choice, the city would make purchasing decisions, allowing it more control over where the energy comes from and switching to community choice is an option in using only renewable energy by 2035, a goal laid out in Mayor Kevin Faulconer's Climate Action Plan.
